Terms of Service

By accessing or using the THEKEY platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, including students, instructors, coordinators, and administrators.

THEKEY is a cloud-based educational platform that provides course management, assignment creation, gamified practice, AI-powered question generation, and secure examination tools for educational institutions in Saudi Arabia and beyond. Features and availability may change over time at our discretion.

To use THEKEY, you must:

• Be at least 13 years of age
• Be enrolled or employed at an institution that has licensed THEKEY, or be invited by an authorized administrator
• Provide accurate and complete registration information
• Agree to comply with all applicable laws and regulations

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access at support@thekey.sa
• Keeping your profile information accurate and up to date

You may not share your account credentials with others or allow any third party to access the platform using your credentials.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorized access to any part of the platform, other user accounts, or backend systems
• Interfere with, disrupt, or overload the platform infrastructure
• Engage in academic dishonesty, including sharing exam content, impersonating other users, or circumventing proctoring measures
• Upload or transmit malware, viruses, or any malicious code
• Scrape, crawl, or otherwise extract data from the platform without written authorization
• Use the Service to harass, bully, or harm other users

All platform software, design, trademarks, and original content provided by THEKEY (“THEKEY Content”) are owned by THEKEY and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from THEKEY Content without express written permission.

Course content uploaded by instructors and institutions (“User Content”) remains the property of the respective rights holder. By uploading User Content, you grant THEKEY a limited, non-exclusive license to host, display, and deliver that content solely for the purpose of operating the Service.

THEKEY integrates tools including Safe Exam Browser (SEB) to support academic integrity during proctored examinations. Users who attempt to bypass, circumvent, or interfere with these security measures may have their exam attempts invalidated and may be subject to disciplinary action by their institution. THEKEY cooperates fully with institutions investigating integrity violations.

Access to certain courses or features may require payment. Where applicable:

• Fees are charged as described at the time of enrollment or subscription
• All payments are processed securely via Stripe; THEKEY does not store payment card details
• Refund eligibility is determined by your institution's refund policy or, where applicable, our standard refund terms communicated at purchase
• Trial periods, if offered, automatically convert unless cancelled before expiry

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using THEKEY, you consent to the collection and use of your information as described in the Privacy Policy.

THEKEY integrates with third-party services including Microsoft OAuth, Stripe, AWS, Resend, Gamma, and others. Your use of those integrations may be subject to the respective third party's terms and privacy policies. We are not responsible for the practices of any third-party service.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. THEKEY does not warrant that the Service will be uninterrupted, error-free, or completely secure.

To the fullest extent permitted by law, THEKEY and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise inappropriate. You may also delete your account at any time by contacting us.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall survive.

These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts in Saudi Arabia.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last Updated” date below. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.
